Terms of Service

Last updated

These terms govern your use of Stockatomics, including the website at stockatomics.com and the Stockatomics Terminal. By creating an account or using Stockatomics, you agree to them. Please read them together with our Privacy Policy and Data Usage policy, which form part of these terms.

1. Who we are

Stockatomics, including the website at stockatomics.com and the Stockatomics Terminal, is operated by Stockatomics.com ("Stockatomics", "we", "us" and "our"). You can contact us at hello@stockatomics.com.

2. The service

Stockatomics is a financial data platform for the physical economy. It provides data, prices, scores, charts and research about critical minerals, the sectors that use them and the listed companies that produce them.

Parts of the website are free to use. The Stockatomics Terminal requires an account and a paid subscription. We keep developing Stockatomics and may add, change or remove features. If a change significantly reduces what your paid subscription includes, we'll tell you in advance, and you may cancel.

3. Information, not advice

Stockatomics provides information. Nothing on Stockatomics is investment, financial, legal, tax or other professional advice, or a recommendation or offer to buy, sell or hold any security, commodity or other investment.

Our scores, rankings and percentile ranks are statistical measures of supply, demand and exposure. They are not ratings of investment merit, and they say nothing about whether an investment is suitable for you. We are not a broker or an investment adviser, and we don't provide personal recommendations.

Any decision you make using Stockatomics is yours alone, and you may wish to take independent advice before making one. Past performance, including the price histories and returns shown on Stockatomics, is not a guide to future results.

4. Accuracy and availability

We work hard to keep our data accurate and up to date. It comes from third-party sources and our own calculations, however, so it may contain errors or delays, and it may be revised when our sources revise their figures. Benchmark prices are dated by the month they describe, which usually trails the calendar.

Stockatomics is provided "as is" and "as available". To the extent the law allows, we don't promise that it will be accurate, complete, current, uninterrupted or free of errors, or that it will suit any particular purpose. Please check important figures against their original sources before relying on them.

5. Your account

  • You must be at least 18 to create an account.
  • Give us accurate information and keep it up to date.
  • Accounts are personal. Don't share your sign-in details or let anyone else use your account.
  • Keep your sign-in details secure. You're responsible for activity on your account, and you should tell us straight away if you think someone else has used it.
  • If you sign in with Google, Google's own terms also apply to that sign-in.

6. Subscriptions and payment

  • A Terminal subscription is billed monthly or annually, in US dollars, at the price shown when you subscribe. Any VAT or similar tax that applies is shown at checkout.
  • Payments are processed by our payment provider. We never see or store your full card number.
  • Your subscription renews automatically at the end of each billing period until you cancel. You can cancel at any time; your access continues until the end of the period you've paid for, and you won't be charged again.
  • We may change our prices. We'll give you at least 30 days' notice before a new price applies to your subscription, and you can cancel before it does.
  • Except where the law gives you a right to one, payments are non-refundable, including for part of a billing period.
  • Nothing in this section affects your legal rights as a consumer, including any right to cancel within 14 days of subscribing.

7. Using Stockatomics and its data

While your account is in good standing, we give you a personal, non-exclusive, non-transferable and revocable licence to use Stockatomics, including the Terminal, for your own personal use or your organisation's internal purposes, in line with these terms and our Data Usage policy.

You must not:

  • copy, scrape or extract our data in bulk, by any automated or manual means, other than as search engines do when indexing our public pages
  • republish, redistribute, sell or sublicense our data, or build it into your own product, database or feed
  • use our data to build a competing data product, index or benchmark
  • use our benchmark prices or scores as a reference in financial products or contracts, such as indices, funds, derivatives or pricing agreements, without a written licence from us
  • use our data, pages or charts to train, fine-tune or evaluate artificial intelligence or machine-learning models, or to build datasets for that purpose
  • get around any access control, including content locked to subscribers
  • copy, reverse engineer or interfere with the software behind Stockatomics, or disrupt its operation
  • remove or hide our attribution or branding, or present our data in a misleading way
  • use Stockatomics unlawfully or in breach of anyone else's rights

If you'd like to use our data in ways these terms don't allow, contact us about a licence.

8. Intellectual property

Stockatomics and its content, including our benchmark prices, scores, rankings, datasets, charts, written content, software, design, name and logo, belong to us or our licensors. They are protected by copyright, database rights and other intellectual property laws.

Some of the source data we use, such as US government statistics, is public. Our selection, compilation, calculations and presentation of it are our own. Apart from the licence in section 7 and the permissions in our Data Usage policy, these terms give you no rights in our content or our brand.

If you send us ideas or feedback, we may use them freely, without any obligation to you.

9. Third-party sources and services

Stockatomics relies on third-party data sources and services, and links to other websites. We aren't responsible for third-party content or services, and a link doesn't mean we endorse them.

10. Suspension and closure

You can stop using Stockatomics and ask us to delete your account at any time.

We may suspend or close your account if you break these terms, if the law requires us to or if your use puts Stockatomics or its users at risk. Where it's reasonable to do so, we'll tell you first. If we close a paid account for any reason other than a breach of these terms, we'll refund the unused part of any period you've paid for.

11. Our liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that the law doesn't allow us to limit or exclude. Nothing in these terms affects your legal rights as a consumer.

Subject to that:

  • we aren't liable for any loss that wasn't reasonably foreseeable when you started using Stockatomics
  • we aren't liable for any loss arising from investment, trading or business decisions you make using Stockatomics
  • if you use Stockatomics for business purposes, we aren't liable for any loss of profit, revenue, business, opportunity or data
  • our total liability to you in connection with Stockatomics is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim and £100

12. Changes to these terms

We may update these terms from time to time. If a change is significant, we'll tell you by email or on Stockatomics at least 30 days before it takes effect. If you don't agree with the new terms, you can cancel before they apply; if you keep using Stockatomics after that, the new terms apply to you.

13. General

  • These terms, together with the policies they refer to, are the whole agreement between you and us about Stockatomics.
  • If a court finds part of these terms unenforceable, the rest stays in effect.
  • If we don't enforce a right straight away, we can still enforce it later.
  • We may transfer our rights and obligations under these terms to another organisation that takes over Stockatomics, for example a company set up to run it. We'll tell you if that happens, and it won't reduce your rights. You may not transfer your rights under these terms without our written agreement.

14. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you're a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts. If you're a consumer in the European Union, you also keep the protection of the mandatory laws of the country where you live.
